Overview of Agency
The Federal Court of Australia (the Entity) is a non-Corporate listed entity under the Public Governance, Performance and Accountability Act 2013 (PGPA Act) and a statutory agency for the purposes of the Public Service Act 1999. The Entity supports the operations of the Federal Court of Australia (FCA), Family Court of Australia (FCoA), the Federal Circuit Court of Australia (FCC) and the National Native Title Tribunal (NNTT) and some other tribunals. The FCA, FCoA and FCC are Chapter III Courts under the Australian Constitution and continue to operate as individual courts.

Position Overview
The role of the Director Security is to provide strategic direction, advice and leadership for the Courts and Tribunals on all security matters. The role is responsible for the development of policies, procedures and practices for the security of the courts, judges and other court personnel as well as for court premises. The Director Security is responsible for the management and oversight of the court’s security contract for guarding services nationally. In conjunction with the Director Property and Procurement, the Director Security will oversight the acquisition, maintenance and replacement of security equipment and apparatus and management of security contracts.

The role will ensure that the Courts and Tribunals intended response to high risk threats are supported by formal processes and structures, contingency arrangements and operational plans to mitigate or reduce them and that these plans are documented and implemented with clear accountabilities and timelines.

The role has a key responsibility in the identification of best practice trends for security management as an input into the development of appropriate policies and protocols. Such information should also be used as a basis for support and advice to key stakeholders, and should inform in partnership with Human Resources personnel any training and development initiatives related to security awareness and the management of security incidents.

The Director Security is required to work cooperatively with key Court and external stakeholders to ensure that security protocols and procedures meet relevant requirements and performance expectations.

The person appointed to the position of Director Security assumes the Marshal responsibility in the role as specified in section 38P of the Family Law Act 1975, the Sheriff and Marshall responsibilities of the Federal Circuit Court of Australia as specified in section 106 and section 109 of the Federal Circuit Court Act 1999 and the responsibilities of a Deputy Sheriff for the Federal Court, as specified in section 18P of the Federal Court Act 1976.

This is a Designated Security Assessment Position (DSAP) with clearance access level of Negative Vetting 1.

The Director Security will be required to undertake interstate travel and be available after hours to co-ordinate any major security matters affecting Court premises, Judicial Officers or staff.

Major Activities

  • Lead the implementation of contemporary physical security practices to ensure the security of court personnel and premises nationally.
  • Ensure that threats to the judiciary, staff, public and other courts users are managed and potential harm is minimised through the application of risk management processes; 
  • Take overall responsibility for the Courts’ and Tribunal’s security ensuring compliance with relevant legislation, regulations and statutory obligations including the requirements under the protective security policy framework.
  • Manage the Courts response to security-related crisis, incidents and emergencies in accordance with the Court’s security framework, and establish monitoring mechanisms across the Court.
  • Manage the security service contract, including effectively leading security contractors to deliver results; ensure performance against service level agreements, adherence to policies and procedures and undertaking security audits and reporting.
  • Foster a positive security culture within the Courts. Raise employee awareness and capability of security risk controls, including coordination of emergency response training programs.
  • Develop security policies, protocols and frameworks that guide and underpin the provision of security services within the courts and tribunals.
  • Establish security performance measures to monitor procedures to achieve required security protection, address risks, counter unacceptable security risks, and improve security maturity.
  • Ensure security reporting is enhanced in order to provide the Heads of Jurisdiction, the Executive and other stakeholders with clear information concerning the prevailing threat environment and operational response activities;
  • Develop and maintain effective working relationships with stakeholders including the judiciary, court user and partner law enforcement and security agencies to ensure security responses to meet stakeholder expectations within available budget and resources.

Competencies & Attributes

  • Previous experience in management of security at a senior level in a complex environment. 
  • Ability to work autonomously and be an excellent communicator will greatly assist with this role.
  • Previous experience in a Court environment will be highly regarded. 

Formal Qualifications
Degree or extensive senior level experience in a relevant field e.g. security, intelligence & risk management.

Special Requirements
Contactable out of hours and flexibility to regularly travel interstate, if required.

Eligibility
Employment with the Court is subject to the conditions prescribed in the Public Service Act 1999, and the following:

  1. Australian citizenship – the successful applicant must hold Australian citizenship;
  2. Security and character clearance – the successful applicant must satisfy a Police Records Check, and be required to complete security clearances during the course of their employment;
  3. Health clearance – the successful applicant may be required to complete a health declaration or attend a medical assessment to confirm their fitness for duty.
